This American Homes 4 Rent’s (“AMH”) California Job Applicant and Employee Privacy Notice (“Privacy Notice”) describes how AMH collects, uses, stores, and shares your information when you apply for a job with, are employed by, or perform work under contract with AMH.

 

Key Definitions

The following definitions apply to this Privacy Notice, please review them carefully:

  • Personal information. Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your household.
  • Sensitive personal information. To the extent applicable, your social security number, driver’s license number, state identification card, passport number, account log-in and password, financial account and password, debit or credit card number, precise geolocation information (within 1,850 feet), race, ethnic origin, religious or philosophical beliefs, union membership, the content of your mail, email or texts other than those communications with us, genetic data, health information, and information that concerns your sex life or sexual orientation.
  • Sell, sale, or sold. Selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or other means, your personal information to a third party for money or other valuable consideration.
  • Share, shared, or sharingShearing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or other means, your personal information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.

 

What Information Do We Collect and Share?

Below is a summary of the categories of personal information, including sensitive personal information, we have collected, and will continue to collect about you. Below that list is information about: (1) why the information is collected and used; (2) whether the information includes sensitive personal information; (3) whether the information is sold or shared to third parties; (4) whether the information is disclosed for a business purpose to third parties; and (5) how long we may keep your information.

  • Identifiers (Includes Sensitive Personal Information: Includes information such as your name, signature, alias, postal address, and telephone number, unique personal identifier, online identifier, IP address, account log-in, email address, account name, social security number, driver’s license number, passport number. Sensitive personal information within this category includes your social security number, driver’s license number, state identification number, and passport number.
  • Personal Characteristics (Includes Sensitive Personal Information): Includes information such as your race, color, national origin, sex, sexual orientation, gender, gender identity, gender expression, religious creed, mental disability, physical disability, medical condition, military / veteran status, marital status, age, genetic characteristics, ancestry, or reproductive health decision making. Sensitive personal information within this category includes information about your health, race, ethnic origin, religious or philosophical beliefs, union membership, or sexual orientation.
  • Financial Information (Includes Sensitive Information): Includes information such as your AMH account name and log-in information, bank account number, and credit card and debit card number. Sensitive personal information in this category includes your account log-in and password, bank account number, and credit card and debit card number.
  • Internet or other Electronic Network Activity Information: Includes information such as your activity on the AMH network and assets, internet browsing and search history while on AMH assets, and information regarding your interaction with the AMH network.
  • Geolocation Information (Includes Sensitive Personal Information): Includes information about your location when performing work for AMH, including when visiting properties and determining your proximity to properties for security purposes. Sensitive personal information in this category includes your precise geolocation, which is defined as information derived from a device that allows us to identify your location within a radius of at least 1,850 feet.
  • Professional and Educational Information (Includes Sensitive Personal Information): Includes information about your work history, education history, prior job performance, and other related professional and educational information. Sensitive personal information in this category includes information relating to any of your protected characteristics, as outlined above.
  • Audio, Electronic, Visual, Thermal, and Related Information: Includes information such as photographs, video recordings, recorded messages, and in some cases personal temperature where appropriate.

What is our business purpose for collecting your information?
  • To process your onboarding documents and continuing to review job status changes.
  • To facilitate your contributions to political action committees, charities, non-profit organizations, and related organizations.
  • To facilitate your contract and/or scope of work.
  • To facilitate your leave of absence, accommodation, or other HR related requests.
  • To manage professional development, performance, and conduct, including responding to complaints of misconduct, managing conflicts of interest, conducting performance appraisals, supporting career development, and managing whistleblower programs.
  • To facilitate payroll, and ensure the administration of benefits for you and your dependents.
  • To obtain emergency contact information.
  • To detect security incidents and protect against deceptive, fraudulent, or illegal activity.
  • To debug and repair errors that impair existing functionality of internal resources, networks, and databases.
  • To mitigate workplace health and safety risks for you and your co-workers.
  • To share between and among subsidiaries and affiliates to carry out the purposes described herein.
  • To share with service providers, including technology providers, travel management providers, HR suppliers, and employment agencies and/or external recruiters.
  • To fulfill a legal obligation pursuant to law, regulation and/or lawful order.
  • For business transaction purposes.
Who do we disclose this information to? To our third party service providers, vendors, partners, charities, non-profits, political action committees, and in some cases governmental agencies.
How long do we keep this information? We keep the information identified above for so long as is reasonably necessary and proportionate to the original purpose for which we collected the information. We base our criteria in determining appropriate retention periods on regulatory and legal requirements, contractual requirements, business needs, and the expectations of you.

We do not sell or share your personal information. We also do not have any actual knowledge of selling or sharing the personal information of any California resident who is 16 years or younger.

We do not process your sensitive personal information outside of the permissible purposes set forth in the CCPA.

 

Rights

You may submit any request below by clicking here or contacting us at 1-844-865-7841. We will verify your identity using the information you provide us with the request. We reserve the right to request additional information for verification purposes. You may designate an authorized agent to submit a request on your behalf. 

  • Right of Access. You may request that we disclose the categories of personal information and sensitive personal information we have collected about you in the 12 months preceding the date of your request, including information about how that information has been used and disclosed. You also have the right to request specific pieces of your personal information and sensitive personal information, subject to exceptions under the CCPA. 
  • Right to Correct. You may request that we correct your personal information in our possession, subject to certain exceptions under the CCPA.
  • Right to Delete. You have a right to submit a request that we delete your personal information and sensitive personal information. We may be unable to complete this request if the information is necessary to complete a transaction with you, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, comply with the law, or to use internally for purposes aligned with your expectations. There are other exceptions that may apply to this request.
  • Right to Non-Discrimination. We will not discriminate against you in any way if you choose to exercise your rights under this section.
